Karnataka HC has restrained Classic Legends and Boman Irani (Co-founder) for the use of the ‘Yezdi’ brand name. The said name is currently under the ownership of Ideal Jawa India Pvt. Ltd. Co which is under liquidation.
After going defunct in 1996, Idea Jawa India Pvt. Ltd. Co continued to be the rightful owner of the Yezdi trademark and other domains including the word/mark Yezdi. Moreover, Ideal Jawa Employees Association filed an application to stay the registrations granted by the Registrar. This was done in a bid to avail funds by selling the marks and releasing dues of the creditors and employees that have been pending for decades.
During the revival of the brand, Boman Irani obtained the registration in his personal capacity which was also addressed by the Karnatak HC. The court has now questioned their conduct and imposed a Rs 10 lakh fine on each. The order’s now under abeyance for the next 30 days.
And to address the same, here's the statement from Classic Legends 'The order is held in abeyance and the company is seeking legal advice on the matter. The company will be filing an appeal against the order shortly and is optimistic of securing favourable relief. In the interim, manufacturing and sale of motorcycles will continue, subject to orders of the Appellate Court.'
